INFOKU, BLORA - Sri Budiyono, a victim of the land mafia, won his appeal at the Semarang High Court (PT) .
Disputed Land & House - ArchivesPreviously, the victim appealed the decision of the Blora District Court (PN) Number 8/Pdt.G/2023/PN.Bla which was won by Blora DPRD member Abdullah Aminuddin.
Budi explained that in decision Number 397/PDT/2023/PT SMG it was stated that the panel of judges accepted the appeal from the original appellants, Defendant I and Defendant II. Then, cancel the Blora District Court decision Number 8/Pdt.G/2023/ PN.Bla dated September 12 2023 which is being appealed.

As well as adjudicating, rejecting the plaintiff's lawsuit in its entirety, punishing the original plaintiff to pay court costs at both levels of court, which at the appeal level was set at IDR 150 thousand.
He also said that he believed that the process of changing the name of his land certificate to Abdullah Aminuddin's was invalid in the eyes of the law.
So, those who lost the civil case at the Blora District Court appealed to PT Semarang.
"After I studied it, it was clear that the process violated Article 38 of Law Number 2 of 2014 concerning Notary Positions," he explained.
Moreover, the process of making the land sale and purchase deed (AJB) did not involve any related parties, including himself.
Apart from that, in the facts of the trial at PT Semarang there were witnesses who supported their side. Namely, in the AJB the witness said he was only presented with a blank form.
"So, this process is also not in accordance with article 1457 of the Civil Code (KUHPer). "And, article 9 of Law Number 5 of 1960 concerning Basic Agrarian Principles Regulations," he stressed.

It should be noted that the land mafia case began when Sri Budiyono borrowed Rp. 150 million from Abdullah Aminuddin with the guarantee of land and building certificates.
In the process, when the debt payment was about to be made, the land certificate had already changed its name without the victim's knowledge. Now, these cases are both ongoing in the criminal and civil realms. (Endah / IST )
