Jomblang Village Head's First Sanction Passed, Next Sanction Depends on Regent

INFOKU, BLORA – It is estimated that the sanctions  against the Head of  Jomblang Village , Jepon District, who is suspected  of violating  the neutrality of the 2024  Pilkada  will continue. 

Despite being cleared of alleged  criminal election violations  , Jomblang Village Head Agus Mukmin cannot yet breathe a sigh of relief.

Because there is still a legal process regarding the alleged violation of neutrality, sanctions are also potentially waiting.

In previous news, the village head in question sang and danced on stage during the campaign event for the candidate pair ( paslon ) for governor and deputy governor of Central Java number 02 Ahmad Luthfi-Taj Yasin.

So, it then became a finding from the Election Supervisory Body ( Bawaslu ) team of Blora Regency.

Blora Bawaslu Chairman Andyka Fuad Ibrahim explained that from the results of the examination and discussions with Gakkumdu, there were initially two alleged violations.

First, regarding the alleged criminal violation of elections which is considered to violate Article 71 of Law Number 10 of 2016 concerning Regional Elections.

"The result during the second discussion with the Gakkumdu center did not meet the elements of alleged criminal election violations. So, it was stopped," he explained.

However, the second alleged violation, namely regarding neutrality, continues.

In this context, the Head of Jomblang Village is suspected of violating the provisions of Article 29 of Law Number 6 of 2014 concerning Villages.

That  village heads  are prohibited from participating and/or being involved in general election campaigns and/or regional head elections.

"If you look at the Village Law, just being present is already included. For that matter, we will continue, we have written to the Regency Government. In this case, the official in charge of personnel development is the regent," he said.

According to him, in this case, the Regent has the authority to impose sanctions.

So what form the sanction takes depends on the Regent.

Referring to Article 30 of the Village Law, Village Heads who violate the prohibitions as referred to in Article 29 will be subject to administrative sanctions in the form of verbal and/or written warnings. 

Meanwhile, in the case of administrative sanctions as referred to in paragraph one not being implemented, a temporary suspension action is taken and can be continued with dismissal.  (Endah / IST )
